The Court finds that for the reasons stated above this action is dismissed, with prejudice, as a sanction for Plaintiff's affirmative false statements regarding his extensive litigation history. TEXT ORDER entered by Judge Joe Billy McDade on 2/19/2025. On 2/6/25 the Court denied Plaintiff's request to proceed without prepayment of fees because he had on three or more prior occasions filed a meritless lawsuit or appeal in federal court. Order #7 . Plaintiff now requests an additional 45 days to pay the filing fee. Motion for Extension of Time #8 . The request is DENIED. The Court determined Plaintiff is not eligible to proceed without prepayment of fees. Plaintiff cannot circumvent that ruling, and the Prison Litigation Reform Act, by requesting extensions within which to pay the fee. Filing fee remains due 2/27/25. Failure to pay the filing fee in full by that date will result in dismissal of this action with prejudice for failure to prosecute and for failure to follow Court orders. (KE)
