April 23, 2025 Opinion or Order TEXT ORDER entered by Judge Jonathan E. Hawley on 4/23/2025. On 4/15/2025, the Court dismissed Plaintiff's Complaint without prejudice because it appeared that his claims were barred by the statute of limitations. The Court ordered Plaintiff to file an Amended Complaint by 5/15/2025. Plaintiff now files a Motion for Reconsideration of Court's Merit Review Order #7 arguing that the Court erred in finding that his claims were barred by the statute of limitations. Plaintiff argues the two-year statute of limitations was "tolled" while he exhausted his administrative remedies. Plaintiff asserts he "submitted an Offender's Grievance for redress of his complaint of 'Intentional Interference with Physical Therapy'" on 2/4/2020, which was not fully exhausted until 5/9/2023. (Doc. #7 at p. 3). Thus, he asserts his Complaint filed on 3/25/2025 was timely. Plaintiff sued Jason Garza, Nellie Boone, and 14 John Doe Defendants. Plaintiff does not demonstrate that the statute of limitations was tolled regarding the conduct of these 16 Defendants. Plaintiff is DIRECTED to file an Amended Complaint on or before 5/23/2025. Failure to file a timely Amended Complaint will result in the dismissal of this case, with prejudice, for failure to state a claim. Plaintiff's Amended Complaint will replace Plaintiff's original Complaint in its entirety. The Amended Complaint must contain all allegations against all Defendants. In his Amended Complaint, Plaintiff must include the dates when each Defendants' alleged conduct occurred and specify whether he complained about their conduct in his grievance. Plaintiff's Motion for Reconsideration #7 is DENIED. (JS)
