TEXT ORDER entered by District Judge Sue E Myerscough on 6/9/2025. This case was dismissed on 6/3/25 due to Plaintiffs failure to file a complaint, as required by Federal Rule of Civil Procedure 3. Judgment entered #7 on 6/4/25 and this case is now closed. Plaintiff subsequently filed a Motion to Clarify Record #8 , indicating that he cannot file a complaint because he has not yet fully exhausted administrative remedies but asking this Court to issue emergency injunctive relief as was done in a Massachusetts state court in Green v. Massachusetts Department of Corrections, 2021 WL 6335670 (Mass. Super. Nov. 30, 2021). The Federal Rules of Civil Procedure do not apply to Massachusetts state courts, nor do precedents in state courts apply to this U.S. District Court. The Court is not aware of any authority it has to grant the requested relief, nor has Plaintiff cited to any such authority. Therefore, Plaintiff's Motion #8 is DENIED, and this case remains closed.
