TEXT ORDER entered by Chief Judge Sara Darrow on December 23, 2025. Plaintiff Heidi Erickson's #21 motion to schedule a hearing is MOOT as it requests a hearing on a motion that has already been denied. Plaintiff #22 moves for a temporary restraining order, writ of replevin, or preliminary injunction. She does not contend that she has provided notice to the parties she seeks relief from. See #22 Mot. TRO 72. Pursuant to Federal Rule of Civil Procedure 65(b)(1) a court can "issue a temporary restraining order without written or oral notice to the adverse party or its attorney" only if (A) "specific facts in an affidavit or a verified complaint clearly show that immediate and irreparable injury, loss, or damage will result to the movant before the adverse party can be heard in opposition" and (B) "the movant's attorney certifies in writing any efforts made to give notice and the reasons why it should not be required." Neither of these requirements have been met. Plaintiff does not state with any specificity why the Court should issue a temporary restraining order before any opposing party can be heard in opposition or indicate any efforts she has made to provide notice. Instead, she simply says that if the Court requires advance notice, she will "send notification of such filings to all parties and attorneys of record." #22 Mot. TRO 72. Accordingly, Plaintiff must provide notice to adverse parties and any adverse parties will be given an opportunity to respond to the motion. She must file proof of notice by Monday December 29, 2025. Plaintiff's #23 motion to change venue is DENIED without prejudice to refiling. Plaintiff requests a transfer of venue to the Northern District of Illinois, but makes no argument as to how the Northern District of Illinois is a proper venue under 28 U.S.C. 1391. (SB)
