TEXT ORDER: Defendants City of Spring Valley, Illinois and Michael Oslanzi have filed an #7 Unopposed Motion for extension of Time to File Answer. The Court identifies two problems. First, the motion indicates that counsel for Defendants filed an appearance in this case on October 16, 2025, but that "the docket does not reflect proof of service" upon the Defendants. Defendants do not indicate whether they have actually been served with the Plaintiff's complaint. Critically, "Rule 12(a)(1)(A)(i) requires a response only from those defendants who have been served." Ledford v. Waldo, 23-cv-2463, 2024 WL 1104785, at *1 (7th Cir. Mar. 14, 2024). It is therefore unclear whether the twenty-one-day period for Defendants to respond to Plaintiff's complaint has in fact begun. Second, Civil Local Rule 6.1 requires parties who request an extension of time to state the "amount of additional time requested." And this Court's Standing Order requires parties who agree to move a deadline to "[s]et forth the deadline the parties seek to move." Standing Order in Civil Cases of U.S. Magistrate Judge Ronald L. Hanna (June 3, 2025), ilcd.uscourts.gov (first, navigate to the "Orders & Rules by Judge" tab, and then select "Local Rules and Orders"). Yet the Court cannot ascertain what Defendants' original deadline to respond is, assuming they have been served with process under Fed. R. Civ. P. (4). Accordingly, Defendants' #7 motion is DENIED without prejudice. Defendants are free to refile their motion to cure the defects outlined in this Order. Entered by Magistrate Judge Ronald L.
