TEXT ORDER entered by Chief Judge Colin Stirling Bruce on 4/14/2026. On March 27, 2026, the Court received, returned as being undeliverable, a Text Order that the Court had sent to Plaintiff on February 18, 2026. That same day, the Court issued another Text Order to Plaintiff ordering him to update his address as required by the Court's Merit Review Order and by Local Rule 16.3(K). The Court gave fourteen (14) days to Plaintiff to update his address, and the Court warned Plaintiff that, if he did not timely do so, the Court would dismiss this case. As of today, Plaintiff has not responded to the Court's March 27, 2026 Order or otherwise provided his current address to the Court. Local Rule 16.3(K) requires every pro se plaintiff to inform the Court of any change of address that occurs during the pendency of his case. Failure to comply with this Local Rule results in the dismissal of the case. Id. The Merit Review Order also required Plaintiff to keep the Court informed of his current address. Plaintiff has failed to comply with the Court's March 27, 2026 Order, with the Court's Merit Review Order, and with the Court's Local Rules, in that, he has not kept the Court informed, in writing, of his current address. As a result, this case is DISMISSED WITHOUT PREJUDICE based upon Plaintiff's failure to comply with Local Rule 16.3(K) and with the Court's Orders. No judgment to enter. (KE)

TEXT ORDER entered by Judge Colin Stirling Bruce on 2/18/2026. Plaintiff's motion to reconsider #8 is GRANTED. Plaintiff asks the Court to reconsider the requirement that he make an initial, partial payment towards his filing fee. Plaintiff asserts that he does not possess the funds with which to make the initial, partial payment imposed by the Court, and he does not believe that he will possess the funds with which to make such a payment in the future. Based upon Plaintiff's representations and the fact that he did not possess any funds in his trust fund account when he filed this lawsuit, the Court will waive the requirement that Plaintiff make an initial, partial filing fee in order to litigate this case. However, Plaintiff remains responsible to pay the $350.00 filing fee, in full, when he is financially able to do so, and this requirement includes making partial payments as outlined by the Court in the Order granting Plaintiff's motion for leave to proceed in forma pauperis. The Court will conduct a merit review of Plaintiff's Complaint, that is required by 28 USC Section 1915A, as soon as the Court's schedule permits. (KE)

TEXT ORDER granting #3 Petition to Proceed In Forma Pauperis. Pursuant to 28 U.S.C. Section 1915(b)(1), Plaintiff is assessed an initial partial filing fee of $2.97. The agency having custody of Plaintiff is directed to forward the initial partial filing fee from Plaintiff's account to the Clerk of Court within 30 days of this order. After payment of the initial partial filing fee (or immediately if no funds are available for that payment) the agency having custody of Plaintiff shall make monthly payments of 20 percent of the preceding month's income credited to Plaintiff's account to the Clerk of Court. Income includes all deposits from any source, including gifts. The agency having custody of the plaintiff shall forward these payments each time Plaintiff's account exceeds $10, until the filing fee of $350 is paid in full. The Clerk is directed to mail a copy of this order to Plaintiff's place of confinement, to the attention of the Trust Fund Office, and to Plaintiff. Prisoner Prepayment due by 3/5/2026.
