TEXT ORDER entered by Chief Judge Sara Darrow on 3/11/2026: Petitioner has filed a Motion for Leave to Proceed in forma pauperis #2 , so that he can proceed without paying the nominal $5.00 filing fee for his Section 2254 Petition. He claims he has no income from any source including gifts, no assets, and no monthly expenses. Petitioner is on mandatory supervised release and is living in an apartment in Arizona. He has managed to pay over $18 in postage to mail in his filings and does not indicate how he would be able to do so if he truly has no money. While it is possible for a petitioner to not have the means to pay the nominal $5.00 filing fee, it is rare. The Court finds the Petitioner's Motion #2 is incomplete and inconsistent with his filings and is therefore DENIED without prejudice. Petitioner shall either pay the $5.00 filing fee or file a new Motion for Leave to Proceed in forma pauperis that accurately explains his financial circumstances. He shall do so within 30 days or his Petition will be dismissed without prejudice. (KLC)
