| Filing 21 DISCOVERY PLAN - PROPOSED/Report of Rule 26(f)Planning Meeting by Charlene Hawkins. (Favaro, Dennis) |
Filing 20
TEXT ORDER: The parties' #19 proposed discovery plan does not comply with Part II of the Court's Standing Order, which provides that a dispositive-motion deadline should generally be within one year of the Rule 16 scheduling conference and that a plan proposing a later deadline must state the reasons for the extended schedule. The parties propose a dispositive-motion deadline more than one year after the Rule 16 scheduling conference without providing any explanation. In addition, the proposed September 1, 2027 dispositive-motion deadline precedes the May 1, 2028 deadline for completing discovery and therefore appears to be erroneous. The Rule 16 scheduling conference set for August 21, 2026, is VACATED. The parties shall confer and file, on or before August 25, 2026, an amended discovery plan that complies with Part II of the Standing Order and provides accurate, internally consistent deadlines. The Court will reset the Rule 16 scheduling conference, if necessary, after reviewing the amended plan. Entered by Magistrate Judge Ronald L. Hanna on August 18, 2026. (NL)

TEXT ORDER: Defendants Jeffery Sholl and Euclid Beverage, LLC's #14 Motion for Extension of Time to Answer or Otherwise Plead is GRANTED. Under Fed. R. Civ. P. 6(b)(1)(A), courts may, for good cause, extend time when a request is made before the original deadline expires. And under Civil Local Rule 6.1, parties seeking an extension must state whether the opposing party consents to it. Defendants Sholl and Euclid have not secured Plaintiff's consent, but the Court nonetheless finds good cause for the limited extension. Accordingly, Defendants Sholl and Euclid must file an answer or other responsive pleading on or by July 13, 2026. Entered by Magistrate Judge Ronald L. Hanna on July 10, 2026. (NL)

TEXT ORDER: The Clerk is DIRECTED to STRIKE Plaintiffs' #4 #5 waivers of service. A review of those waivers demonstrates that they include the incorrect case numbers. Indeed, both identify the case number as "26 CV 4508," when the number assigned to this case is in fact "4:26-cv-4058." The "5" and the "0" has thus been improperly transposed. Accordingly, Plaintiff must re-issue the waivers of service with the correct case numbers. Entered by Magistrate Judge Ronald L. Hanna on May 8, 2026. (DW)
