Sec. 1915A, Plaintiffs alleged sufficient facts to proceed on a First Amendment claim against Defendants Erin Posey, Ashley Gregory, Thomson, Janna Spencer, and Amber Reische. March 26, 2026 Opinion or Order Filing 13 TEXT ORDER: This Court has instituted a reduced filing fee procedure for indigent plaintiffs who are institutionalized but who are not prisoners as defined in 28 USC Section 1915(h). A reduced payment will be assessed of 50% of such plaintiff's average monthly income for the six months preceding the filing of the complaint (not to exceed the $405 filing fee). Income includes all deposits from any source. Plaintiff Kristopher Sewell is currently detained at Rushville Treatment and Detention Facility, and is thus subject to the reduced payment procedure. Plaintiff's ledgers for the past six months show an average monthly income of $12.76. Plaintiff is ordered to send an institutional check or money order in the amount of $6.38, payable to Clerk, U.S. District Court within 30 days from the date of this order. The reduced fee may be waived if the plaintiff, within 14 days of this order, files a motion to waive the fee and demonstrates good cause for such waiver. March 16, 2026 Opinion or Order Filing 5 TEXT ORDER entered by District Judge Jonathan E Hawley on 3/16/2026. On March 16, 2026, Plaintiff Devin Kugler filed a Complaint #1 which lists three additional Plaintiffs, including Kristopher Sewell, John Smith, and Tenorio. However, the pleading is only signed by Plaintiff. (Doc. 1 at p. 37). Because Plaintiff is not a lawyer, he cannot represent anyone but himself; thus, all Plaintiffs are required to sign every filing. See AsymaDesign, LLC v. CBL & Assocs. Mgmt., Inc., 103 F.4th 1257, 125859 (7th Cir. 2024) (citing Fed. R. Civ. P. 11(a)). District Courts must strike unsigned pleadings. Marcure v. Lynn, 992 F.3d 625 (7th Cir. 2021). The Clerk is directed to STRIKE Plaintiff's Complaint. Plaintiff is allowed 21 days to file an Amended Complaint either 1) naming himself solely as Plaintiff, or 2) signed by all Plaintiffs. If multiple Plaintiffs intend to sue together, each will be required to pay a filing fee or file their own Motion for Leave to Proceed in forma pauperis.
