Plaintiff's Amended Complaint #14 does not address or correct the pleading defects identified in the court's merit review order #11 . The Amended Complaint persists in the theory that Plaintiff was deprived of due process when he was erroneously released from custody and does not describe any conduct by any actor that could reasonably be argued to have been in violation of a constitutional right. The court therefore DISMISSES the Amended Complaint for failure to state a claim pursuant to 28 U.S.C. Section 1915A. Additionally, the court finds that further attempts at amendment would be futile, so leave to amend is denied. This action is dismissed with prejudice for failure to state a claim. (SAG)

Section 1915(b)(1), Plaintiff is assessed an initial partial filing fee of $18.50. The agency having custody of Plaintiff is directed to forward the initial partial filing fee from Plaintiff`s account to the Clerk of Court within 30 days of this order. After payment of the initial partial filing fee (or immediately if no funds are available for that payment) the agency having custody of Plaintiff shall make monthly payments of 20 percent of the preceding month`s income credited to Plaintiff`s account to the Clerk of Court. Income includes all deposits from any source, including gifts. The agency having custody of the plaintiff shall forward these payments each time Plaintiff`s account exceeds $10, until the filing fee of $350 is paid in full. The Clerk is directed to mail a copy of this order to Plaintiff`s place of confinement, to the attention of the Trust Fund Office, and to Plaintiff. Prisoner Prepayment due by 6/10/2026. (KE)

April 27, 2026 Filing 5 TEXT ORDER entered by Chief District Judge Colin Stirling Bruce on 4/27/2026. Plaintiff's motion for leave to proceed in forma pauperis #3 is DENIED with leave to re-file. Plaintiff has moved the Court for leave to proceed in forma pauperis in this case. However, the Court has only received the first page of Plaintiff's IFP motion. As such, Plaintiff's motion does not contain sufficient information with which the Court can determine if Plaintiff qualifies for IFP status. More importantly, Plaintiff has not signed his IFP motion under the penalties for perjury. Accordingly, Plaintiff's motion for leave to proceed in forma pauperis is denied with leave to re-file his motion. The Clerk of the Court is directed to send the Court's IFP motion to Plaintiff. Plaintiff is not required to use the Court's form, but if he does, Plaintiff must complete and file the entire form, including signing the form under the penalties for perjury. If Plaintiff does not use the Court's form, Plaintiff must, in his motion, provide all of the information that is requested by the Court's form, including signing his motion under the penalties for perjury. Plaintiff must re-file his IFP motion or pay the required filing fee by May 22, 2026. If Plaintiff does not re-file his motion for IFP or pay the filing fee in full, the Court will dismiss this case.
