Filing 522 MINUTE entry before Honorable Sharon Johnson Coleman:This Court having heard oral arguments and reviewed the briefs and relevant material on Trading Technologies' (TT) Motion for Reconsideration, or in the Alternative to Sever/Stay Claims Relating to Infringement based On Use/Sales of Third Party Products or for Clarification #512 finds that, contrary to TT's assertion, CQG and GL or any other unnamed third party, are not "in the case." In TT's Answer to the Complaint and Counterclaim, it made only general reference to "third party software" and made no specific mention of any particular software. This Court will not permit as a basis for liability or damages against RCG, generalized averments of unidentified "third-party software." Moreover, in TT's Preliminary Infringement Contentions with Respect to Rosenthal Collins Group's Products [Dkt. 42], TT expressly states that RCGOnyx is the only product that it contends is infringing in this case. This Court also rejects TT's argument that a broad-based discovery request brings CQG and GL under the umbrella of this Courts default order. RCG asserts that the Orders present controlling, contestable questions of law and that immediate appellate review would accelerate the litigation. This Court disagrees.Section 1292(b) states in relevant part that: "When a district judge... shall be of the opinion that such order [the one being appealed] involves a controlling question of law as to which there is substantial difference of opinion and that an immediate appeal from the order may materially advance the ultimate termination of the litigation, he shall so state in writing in such order." As cited by RCG, the Seventh Circuit held in Ahrenholz v. Bd. of Trustees, 219 F.3d 674, 675 (7th Cir. 2000): There are four statutory criteria for the grant of a section 1292(b) petition to guide the district court: there must be a question of law, it must be controlling, it must be contestable, and its resolution must promise to speed up the litigation. There is also a nonstatutory requirement: the petition must be filed in the district court within a reasonable time after the order sought to be appealed. (internal citation omitted).This case has been pending since 2005 and there is no promise that an interlocutory appeal would in any way advance or speed up the litigation. In fact, appeal at this juncture would result in further delay. All that remains of this case is a three to five day trial on damages. At the current stage of litigation, any decision by the federal circuit in this case would result in remand to this Court for further proceedings. The same is not true if this matter proceeds to trial on damages. Therefore, RCGs request for certification of interlocutory appeal is denied.Mailed notice (keg, ) |
