August 28, 2012 Opinion or Order Filing 302 MINUTE entry before Honorable Robert M. Dow, Jr: Pursuant to Memorandum Opinion and Order, dated 8/28/2012, the Court grants Defendants' motion for summary judgment as to Count III in its entirety and as to Counts VI and VII to the extent that they seek recovery on the basis of the federal Magnuson-Moss Warranty Act (MMWA). Defendants' motion #251 is denied without prejudice in all other respects. The Court declines to exercise supplemental jurisdiction over Plaintiff's remaining state law claims against Defendants Barrington Motor Sales RV, Sean Bransky, and Bryan Bransky. Those claims are dismissed without prejudice to refiling in state court.8 In addition, Plaintiff's claims against Monaco Coach are dismissed as moot in light of Plaintiff's acknowledgment that it did not file a claim in Monacos bankruptcy case and now would be time-barred from doing so. (Motion at 1). Judge Dow sent the matter here on March 13, 2009, and the parties appeared on the motion this morning. A review of the motion revealed two things. First, there had not been compliance with Local Rule 37.2 which provides: "this court shall hereafter refuse to hear any and all motions for discovery and production of documents under Rules 26 through 37 of the Federal Rules of Civil Procedure, unless the motion includes a statement (1) that after consultation in person or by telephone and good faith attempts to resolve differences they are unable to reach an accord, or (2) counsel's attempts to engage in such consultation were unsuccessful due to no fault of counsel's. Where the consultation occurred, this statement shall recite, in addition, the date, time and place of such conference, and the names of all parties participating therein. Where counsel was unsuccessful in engaging in such consultation, the statement shall recite the efforts made by counsel to engage in consultation." The purpose of the rule is "[t]o curtail undue delay and expense in the administration of justice." The Rule ultimately rests on what Holmes called the shortness of life and the reality that there is a never ending procession of cases that compete for judicial attention. Each hour needlessly spent on a dispute could be profitably spent on a case in which resolution of the issues could only come from the court. See Chicago Observer, Inc. v. City of Chicago, 929 F.2d 325, 329 (7th Cir. 1991)("Litigation is costly not only for the litigants but also for parties in other cases waiting in the queue for judicial attention."). Indeed, this is a problem that the Seventh Circuit has repeatedly addressed. See, e.g., Otto v. Variable Annuity Life Ins. Co., 134 F.3d 841, 854 (7th Cir.1998); Szabo Food Service, Inc. v. Canteen Corp., 823 F.2d 1073, 1077 (7th Cir.1987); Channell v. Citicorp Nat. Services, Inc., 89 F.3d 379, 386 (7th Cir.1996). The second difficulty with the motion is that it did not specify in what particulars "BMS has failed to comply with the discovery requests of Plaintiff." (Motion at 4, paragraph 14). To make that determination, one had to compare the requests with the answers and then to speculate in what ways the plaintiff thought the responses deficient. But it is not for a court to make that determination unaided. Cf. Tyler v. Runyon, 70 F.3d 458, 466 (7th Cir.1995). As Judge Posner has explained, "[i]f we assume the lawyers' responsibilities, we unbalance the market for legal services and take time away from our consideration and decision of other cases." Luddington v. Indiana Bell Telephone Co., 966 F.2d 225, 230 (7th Cir. 1992). See also United States v. Cronic, 466 U.S. 648, 655 (1984); Dal Pozzo v. Basic Machinery Co., Inc., 2006 WL 2548250 at *4 (7th Cir. 2006); Bretford Mfg., Inc. v. Smith System Mfg. Corp., 419 F.3d 576, 581 (7th Cir.2005). While the Seventh Circuit has stressed the importance of compliance with local rules, FTC v. Bay Area Business Council, Inc., 423 F.3d 627 (7th Cir. 2005), it has also recognized that Local Rules have their limitations, and like all rules, they must have sufficient flexibility and must be applied to accomplish the ends of justice and "not bury it beneath the pressure of their own weight," Joseph Story, Miscellaneous Writings, 210 (1852). For that reason, our Court of Appeals, like all others, has recognized the broad discretion invested in district courts to determine how and when to enforce local rules. Waldridge v. American Hoechst Corp., 24 F.3d 918, 923 (7th Cir.1994). That discretion subsumes within it the authority to decide when a departure from Local Rules should be excused. Somlyo v. J. Lu-Rob Enterprises, 932 F.2d 1043, 1048 (2nd Cir.1991). Cf. Brengettcy v. Ilorton, 423 F.3d 674 (7th Cir.2005) ( "noncompliance with a court's local rules does not create a jurisdictional bar for the district court or for us."). It seemed to me that in this case, considerations of judicial efficiency counseled hearing the case notwithstanding the noncompliance with Local Rule 37.2, and thus I instructed the parties immediately to meet and confer. I reminded them of Judge Easterbrook's panel opinion in Rickels v. City of South Bend, Indiana, 33 F.3d 785, 786-87 (7th Cir. 1994): "'The great operative principle of Rule 37(a)(4) is that the loser pays.' [citing 8 Wright & Miller, Federal Practice and Procedure, 2288 at 787 (1970)]. "Fee shifting, when the judge must rule on discovery disputes, encourages their voluntary resolution and curtails the ability of litigants to use the legal process to heap detriments on adversaries (or third parties) without regard to the merits of the claims." (parenthesis in original). Later in the morning, counsel for both parties informed me that they believed that their meeting had been fruitful and that they believed they could work out the discovery dispute. Thus, they asked that the motion be entered and continued for two weeks. In an attempt to give some overall guidance, we discussed the Seventh Circuit's unreported (and thus nonprecedential) decision in Continental Ins. Co. v. Chase Manhattan Mortgage Corp., in which the court in an unpublished order concluded that a district court abused its discretion in requiring a party to Bates-stamp documents being produced in discovery. 59 Fed.Appx. 830 (7th Cir. 2003). I also discussed with the parties the limitations imposed by Rule 33(d) on a party's responding to an interrogatory by producing documents in lieu of a specific answer. See generally In re Sulfuric Acid Antitrust Litigation, 231 F.R.D. 351, 366 (N.D.Ill. 2005). The parties are to be commended for their willingness to approach the present controversy in the cooperative spirit manifested by them this morning and as evidenced by their prior dealings with each other.
