April 28, 2011 Filing 27 MINUTE entry before Honorable Edmond E. Chang: With regard to Defendant's motion to strike class allegation #23 , Plaintiff shall respond on or before 05/19/11. Defendant shall reply on or before 05/26/11. With regard to the discovery schedule, after considering the parties' competing proposals, the Court orders as follows: both merits and class-certification-related (and collective-action) discovery shall proceed simultaneously, rather than one rigidly preceding the other. There will likely be substantial overlap between merits and class-certification-related discovery, including overlapping written discovery and depositions, and simultaneous discovery offers the best chance of expeditiously progressing the case toward both a class-certification resolution and a potential merits resolution. Rule 26(a)(1) disclosures are due on or before 05/17/11. Written discovery to issue on or before 05/31/11. Fact discovery shall close 08/29/11. Of course, if the motion for collective-action and class-action certification is granted, then the Court will consider the scheduling of another date for merits discovery as to the additional collective/class plaintiffs. The motion for collective-action and class-action certification (assuming the motion to strike the class allegation is denied) is due on or before 09/26/11. Defendant's response due 10/26/11; Plaintiff's reply due 11/09/11. When discovery has advanced sufficiently, if either party believes that a summary judgment motion is appropriate as to the merits of Plaintiff's claims, then the respective party may file a summary judgment motion, bearing in mind Rule 56(d). Status hearing is set for 06/09/11 at 8:30a.m., which shall also serve as the continued date for the motion to strike class allegation #23 .Mailed notice (slb, )

April 14, 2011 Filing 21 DECLARATION of Alina Tamas regarding Response #19 Supplemental Declaration of Alina Tamas in Support of Plaintiffs Response to Defendants Motion for Evidentiary Hearing and Protective Order (Werman, Douglas)
April 6, 2011 Filing 20 MINUTE entry before Honorable Edmond E. Chang: Hearing held on Defendant's motion for protective order #11 . Upon review of the circumstances, including the declarations filed by Defendant's employees, and the responsive declarations filed by Plaintiff and her attorneys, the Court preliminarily finds that Defendant has failed to carry its burden to show the necessity for a protective order. In an abundance of caution, the Court orders that Plaintiff file a supplemental declaration on or before 4/20/2011 averring whether she facilitated the entry into Defendant's store of any person (not just her attorneys of record in this case) to obtain Defendant's business records without authorization. Upon receipt of that declaration, the Court will issue a final disposition on the motion. With regard to Plaintiff's attorneys of record, the Court finds that they did not impermissibly enter the store as alleged by Defendant nor did they commit any wrongdoing. Plaintiff's oral motion to seal Defendant's motion is denied; Defendant's oral motion to strike Plaintiff's request for sanctions is denied, but the motion for sanctions itself is denied. Status hearing set for 4/28/2011 at 8:30a.m.Mailed notice (slb, )

March 25, 2011 Filing 18 MINUTE entry before Honorable Edmond E. Chang: With regard to Defendant's motion to quash #14 , the Court appreciates the prompt response filed by Plaintiff's counsel today. At this time, the motion to quash is granted, even though the depositions were intended to cover only the declarations filed in support of Defendant's motion for an evidentiary hearing and protective order #11 , because Plaintiff does not need the depositions to respond with a declaration based on her personal knowledge, nor has the Court decided whether to hold an evidentiary hearing; that decision will be made at the 04/06/11 motion-hearing (not evidentiary-hearing) date. Indeed, even if an evidentiary hearing on the requested protective order is granted, it is not a certainty that in-advance depositions or discovery will be permitted. Mailed notice (slb, )
