WRITTEN Opinion entered by the Honorable Matthew F. Kennelly on 12/7/2011: Defendant's motion to dismiss [# 32 ] is granted. Plaintiff's federal claims are dismissed without prejudice. Plaintiff is given until January 13, 2012, to submit a motion for leave to file an amended complaint, together with a proposed amended complaint that sets forth a federal claim. Plaintiff's "Motion for Psychological Evaluation, Appointment of Counsel, Time Extension" [# 37 ] is denied. P laintiff's failure to submit a timely and proper motion to amend and proposed amended complaint in accordance with this order will result in the dismissal of the case for lack of subject matter jurisdiction. Kennelly on 4/5/2011: The Clerk shall enter plaintiff's in forma pauperis application in case no. 11 C 1435 [#3] as his in forma pauperis application in this case.
