WRITTEN Opinion: Plaintiff's motion to proceed in forma pauperis [#9] is denied. By order of 6/6/2011, Plaintiff was given an opportunity to submit a properly completed and certified application to proceed in forma pauperis, and an acceptable co mplaint. Plaintiffs amended complaint is not acceptable, and it is now clear that Plaintiffs allegations fail to state a claim. Plaintiffs complaint is dismissed pursuant to 28 U.S.C. § 1915(e)(2)(B) and for lack of jurisdiction. The case is dismissed without prejudice to pursuing his claims in state court.
