Filing 59 WRITTEN Opinion entered by the Honorable Gary Feinerman on 1/28/2013: For the reasons set forth below, Defendant Chmell's motion to dismiss 39 is granted, and the motion to dismiss filed by Defendants Williams and Ghosh 19 is denied. The cl aims against Defendant Chmell are dismissed, and the Chmell is terminated as a party defendant. Plaintiff's "motion in response" 49 is denied to the extent it also serves as a motion for sanctions. The Clerk is directed to issue alia s summons for service on Defendant Wexford Health Sources, Inc., and the U.S. Marshals Service is appointed to serve summons on Wexford. The Marshals Service shall send Plaintiff any service forms he must complete, and is authorized to mail a request for waiver of service to Wexford in the manner prescribed by Fed. R. Civ. P. 4(d)(2) before attempting personal service. All of the remaining defendants shall answer the complaint by 02/19/2013. Filing 5 WRITTEN Opinion entered by the Honorable Gary Feinerman on 9/6/2011. Plaintiff's motion for leave to proceed in forma pauperis 3 is granted. The trust fund officer at Plaintiff's place of incarceration shall deduct $26.89 from Plai ntiff's account for payment to the Clerk of Court as an initial partial filing fee, and shall continue making monthly deductions in accordance with this order. The Clerk shall send a copy of this order to the trust fund officer at the Stateville Correctional Center. The complaint is dismissed on initial review as to Defendants Hardy and Karraker pursuant to 28 U.S.C. § 1915A. The Clerk shall issue summonses for service on all other Defendants, and U.S. Marshal is appointed to serve sum mons. The Clerk shall send Plaintiff a Magistrate Judge Consent Form and Instructions for Submitting Documents, along with a copy of this order. Plaintiff's motion for appointment of counsel 4 is denied without prejudice. The Marshal is requested to note the special service instructions set forth in this order.
