Filing 221 MEMORANDUM Order: This Court expects full compliance with than undertaking on plaintiff Brown's part, so it further continues defendant Health Care's motion to enforce the obligation (Dkt. 216) until April 10, 2015. If before that date defendant Health Care confirms that payment has been made, its enforcement motion will be denied as moot. (For further details see Memorandum Order) Signed by the Honorable Milton I. Shadur on 1/16/2015:Mailed notice(clw, ) |
Filing 220 MEMORANDUM Order: This memorandum order requests a progress report from the litigants at an early date (that report can be informal in nature, rather than calling for a formal filing) Signed by the Honorable Milton I. Shadur on 1/8/2015:Mailed notice(clw, ) |
Filing 196 MEMORANDUM Opinion and Order. In sum, Brown's earlier filing on which she has chosen to rely as her current response fails entirely. Health Care's request for $13,118 as the appropriate measure for the original award of sanctions, to which should be added its more recent request for an additional $1,609 (an amount that was found entirely reasonable and was granted in this Court's August 18 opinion), is ordered to be paid by Brown. Accordingly judgment is ordered to be e ntered in favor of Health Care and against Brown in the aggregate sum of $15,420 -- a separate judgment pursuant to Budinich v. Becton Dickinson & Co., 807 F.2d 155 (10th Cir. 1986). Signed by the Honorable Milton I. Shadur on 8/26/2014. Mailed notice(tlp, ) |
Filing 188 MEMORANDUM Opinion and Order. None of Brown's current arguments has any force, and Health Care's request for an additional $1,609.00 in attorneys' fees is entirely reasonable and is granted. Meanwhile this Court's understan ding is that Brown has not responded to Health Care's earlier itemization (sent to her by Health Care on March 4 of this year) of the first imposed sanctions. In that respect Brown is ordered to respond forthwith with any objections that she may have to Health Care's earlier request of $13,811.00, so that this Court can quantify her total liability for attorneys' fees thrust on Health Care by her sanctionable conduct. Signed by the Honorable Milton I. Shadur on 8/18/2014. Mailed notice(tlp, ) |
Filing 154 MEMORANDUM Opinion and Order Signed by the Honorable Milton I. Shadur on 5/6/2014. Mailed notice by judge's staff. (srb,) |
