December 23, 2013 Opinion or Order Filing 91 ENTER MEMORANDUM OPINION AND ORDER: For the reasons stated, the Court grants Roseland Community Hospital's motion to join Dr. Sajjad's motion for summary judgment 62 . The Court also grants Defendants' motion for summary judgment 52 and enters judgment in favor of Defendants and against Plaintiff. Plaintiff Archie Brown's claims are dismissed. The Court also denies Plaintiff's motion for supplemental jurisdiction over his state-law claims 72 , as the Court addressed this contention in its orders of 8/23/12 [see 36] and 3/21/13 [see 49]. To the extent the Third Amended Complaint asserts state-law claims of negligence or malpractice, the claims are dismissed. The Court will read the allegations in the Third Amended Complaint as asserting only deliberate indifference claims. The motion to dismiss is denied with respect to Defendants' contention that they cannot be considered state actors under 42 U.S.C. § 1983. April 4, 2012 Opinion or Order Filing 13 WRITTEN Opinion entered by the Honorable Robert M. Dow, Jr on 4/4/2012: Plaintiff's motion for leave to file an amended complaint (# 76 in case no. 10 C 3609) is granted. His amended complaint should be filed in case no. 12 C 49. Plaintiff may proceed with his amended complaint (# 12 in case no. 12 C 49) against Dr. Sajjad and Roseland Community Hospital. The Clerk shall issue summons for service of the amended complaint on these Defendants by the U.S. Marshal. The Court clarifies that its 2/13/12 order in case no. 10 C 3609 # 67 consolidated these cases for discovery only. A separate clarification order will be entered in case no. 10 C 3609. This order will be entered in only case no. 12 C 49. Plaintiff still may file an amended complaint in case no. 10 C 3610 in accordance with the Court's 3/13/12 order.
