June 14, 2012 Opinion or Order Filing 14 WRITTEN Opinion entered by the Honorable Joan H. Lefkow on 6/14/2012: The Court has reviewed plaintiff's amended complaint, 28 U.S.C. 1915A. The Clerk is instructed to file the amended complaint. (Dkt. No. 12 ). Plaintiff's official ca pacity claims against defendants Dart, Hart and Fagus and John Doe are dismissed without prejudice. Plaintiff is given leave to submit a second proposed amended complaint if he so desires. Plaintiff may proceed with his individual capacity claim against the John Doe defendant and he may conduct discovery on Sheriff Dart to determine the John Doe defendant's identity. The Clerk is instructed to issue a summons for service on Sheriff Dart only. The U.S. Marshals Service is appointed to effectuate service on the defendant. April 25, 2012 Opinion or Order Filing 6 WRITTEN Opinion entered by the Honorable Joan H. Lefkow on 4/25/2012: The plaintiff's motion for leave to proceed in forma pauperis (Dkt. No. 3 ). is granted. The Court authorizes and orders Cook County Jail officials to deduct $10.10 f rom the plaintiff's account, and to continue making monthly deductions in accordance with this order. The clerk shall send a copy of this order to the Supervisor of Inmate Trust Fund Accounts, Cook County Dept. of Corrections Administrative O ffice, Division V, 2700 S. California, Chicago, IL 60608. However, summonses shall not issue at this time. Plaintiff's motion for appointment of counsel (Dkt. No. 4 ), is granted. The Court appoints Mr. Larry L. Saret of Michael Best & Fredri ch LLP, Two Prudential Plaza, 180 North Stetson Avenue, #2000, Chicago, IL 60601 to represent the plaintiff in accordance with counsel's trial bar obligations under the District Court's Local Rule 83.37 (N.D. Ill.). Mr. Saret is instructe d to consult with his client and investigate plaintiffs claims under counsel's Fed. R. Civ. P. 11 obligation. Plaintiff is instructed to submit a proposed amended complaint by no later than June 11, 2012. If appointed counsel is unable to file an amended complaint, he should so inform the Court.
