September 24, 2013 Opinion or Order Filing 40 ENTER MEMORANDUM OPINION AND ORDER: the Court concludes as a matter of law that the USCIS did not err in determining that the Paets do not qualify for adjustment of status and, therefore, the Paets' second amended complaint fails to state a c laim upon which relief may be granted. Thus, the Court grants Defendants' motion to dismiss 26 . The Court denies as moot Plaintiffs' both motion for summary judgment 30 and Defendants' motion to continue or stay consideration of Plaintiffs' motion for summary judgment 35 .
