November 6, 2012 Opinion or Order Filing 15 WRITTEN Opinion entered by the Honorable Rebecca R. Pallmeyer on 11/6/2012: Plaintiff's motion to leave to file in forma pauperis 5 is granted. The Court authorizes and orders the trust fund officer at Plaintiff's place of incarceration to deduct $57.00 from Plaintiff's account for payment to the Clerk of Court as an initial filing fee, and to continue making monthly deductions in accordance with this order. The Clerk is directed to forward a copy of this order to the Inma te Trust Office at the Cook County Jail. As Plaintiff has failed to state a claim against Defendant Marcus Hardy, Hardy is dismissed as a Defendant. The Clerk shall issue summons to Defendant Diane Schwarz, and the U.S. Marshal is directed to serve h er. The Clerk is further directed to send Plaintiff a Magistrate Judge Consent Form, Instruction for Submitting Documents, and a copy of this order. Plaintiff's motion for appointment of counsel 3 is denied. Plaintiff's proposed second amended complaint 7 is dismissed without prejudice and all other motions are denied as moot.
