Filing 35 MEMORANDUM OPINION AND ORDER signed by the Honorable Matthew F. Kennelly on 8/23/2013: For the reasons stated in the accompanying decision, the Court grants the individual defendants' motion to dismiss [dkt. no. 25] and grants in part and denie s in part the City's motion to dismiss [dkt. no. 17]. All claims against defendants Emanuel, Davis, Mintle, and Holt are dismissed for failure to state a claim. As to the City of Chicago, all claims other than Count 3 of the second amended co mplaint are dismissed for failure to state a claim. The City is directed to answer that claim by no later than 9/23/2013. Both sides are to make Rule 26(a)(1) disclosures by that same date. The case is set for a status hearing on 9/27/2013 at 9:30 a.m. for the purpose of setting a discovery schedule. (mk) |
