Having review the parties' Joint Memorandum Regarding Class Notice #142 and entertained oral argument from the parties, the Court: (1) adopts the parties Agreed Class Notice, which is attached as Exhibit 1 to their Joint Memorandum Regarding Class Notice #142 , and (2) adopts Defendant's proposed "targeted individual notice" procedure, see #142 at 5-6, and rejects Plaintiffs' proposal. Only Defendant's proposal fulfills Federal Rule of Civil Procedure 26(c)(2)(B)'s mandate that class notice be the "best notice that is practicable under the circumstances, including individual notice to all members who can be identified through reasonable effort." Defendant proposes having Plaintiffs cull the very class registration logs that Plaintiffs credited in support of their class certification motion to identify potential class members. E.g., Plaintiffs Class Certification Motion #117 at 3 ("The logbooks allow the identification of the members of the putative class."). Plaintiffs thus will be able to identify from the "Reason for Being Turned Away" field in the logs a universe of sex offenders who arguably may have been turned away because they lacked a residence at the time of registration. Perhaps there may be an argument that the logbooks are underinclusive (and this Court does not see one, indeed, Plaintiffs previously argued that the logbooks "should contain the name and date of application for each person who sought to register," #117 at 3), but Plaintiffs have not raised it, despite already having the logbooks in their possession. By comparison, Plaintiffs propose a dual procedure that, as Defendant correctly argues, is both underinclusive and vastly overinclusive (as Plaintiffs themselves acknowledged at the 3/30/16 status hearing and motion papers, see #142 at 3), and certainly no better than Defendant's "targeted individual notice" procedure. Sacramento shelter based on a determination that the shelter is located within 500 feet of a school or daycare. This remedy was not sought by Plaintiffs complaint in this matter, which does not address the aforementioned criminal provision or its application to Plaintiffs. Plaintiffs' complaint instead focuses on Defendant' s alleged refusal to permit homeless persons to register every seven days under the Illinois Sex Offender Registration Act, 730 ILCS 150. Plaintiffs have thus failed to articulate a basis for the relief sought by their motion for a temporary restraining order under the present complaint, and accordingly have fallen short of their burden of demonstrating a likelihood of success on the merits of a claim for that relief. Plaintiffs' motion is therefore denied.The denial is without prejudice. Plaintiffs are granted leave to file an amended complaint and a renewed motion for emergency injunctive relief by 4:00 p.m. on 12/18/2013. The parties are encouraged to continue discussions on agreed short-term procedures that would preserve the safeguards for those protected by the criminal statute while minimizing the impact upon Plaintiffs and those similarly situated.
