| Filing 79 MINUTE entry before the Honorable John Robert Blakey: This case arises out of the crash landing of LOT Polish Airlines Flight No. 16 from Newark, New Jersey to Warsaw, Poland on November 1, 2011. The parties were able to reach an agreement to settle the claims of all 131 plaintiffs in this case and two related cases, including the claims of all minor plaintiffs. The case is before the Court on plaintiffs agreed motion to approve the settlement of these claims #77 . Under Local Rule 17.1, a proposed settlement of an action brought by or on behalf of an infant or incompetent may not become final without the written approval of the Court. L.R. 17.1. Here, such approval is warranted. Having reviewed the parties submissions, the Court finds that the settlement is fair, reasonable and adequate. The litigation progressed to a stage where the parties could fairly evaluate and weigh the merits of the plaintiffs claims, the potential damages, the merits of defendants defenses and the probable course of future litigation. Additionally, the settlement is the product of an arms length negotiation between experienced counsel on both sides. The Court further finds that the requested fees and costs are fair and reasonable. Accordingly, the motion to approve the settlement of the minor plaintiffs claims #77 , including the award of fees and costs, is granted. Payment of the settlement amount owed to each minor plaintiff shall be paid to the legal guardians/parents of each minor plaintiff. The minor plaintiffs' claims are hereby dismissed with prejudice.
