Because the Court lacks personal jurisdiction over Defendant, it does not assess the merits of Defendants alternative requests to dismiss for improper venue, transfer venue, and to dismiss certain counts of Plaintiffs amended complaint for failure to state a claim. See Walden, 2014 WL 700098, at *3 n.5 ("Because we resolve the case on jurisdictional grounds, w e do not decide whether venue was proper in Nevada.").4 The case is dismissed without prejudice to re-filing in a forum that may exercise personal jurisdiction over Defendant.
