Filing 67 STIPULATION of Dismissal With Prejudice (Giampietro, Wayne) |
Filing 66 MINUTE entry before the Honorable Edmond E. Chang: Status hearing held. Plaintiff's counsel reported, without objection from defense counsel (who was not lead counsel and not provided information by lead counsel), that the parties had agreed to ask this Court to terminate the order of 01/13/2014, R. 40, as of 09/30/2014. That order, which require the parties to equally bear website maintenance expenses, shall terminate as of 09/30/2014. The parties now should be in a position to very promptly file the stipulated dismissal. Status hearing set for 09/12/2014 at 8:30 a.m., with no appearance required if a stipulated dismissal is filed before that date. Emailed notice (slb, ) |
Filing 65 MINUTE entry before the Honorable Jeffrey Cole: The parties report that the case is settled. All matters related to the referral having been accomplished, the referral is closed and the case returned to Judge Chang. Judge Honorable Jeffrey Cole no longer referred to the case.Mailed notice (jms, ) |
Filing 64 MINUTE entry before the Honorable Jeffrey Cole: Status hearing held. Settlement Conference is set for 8/25/2014 at 12:00 PM in Courtroom 1003. This is a firm date. Any request to alter this date MUST BE MADE BY MOTION AND NOTICED FOR HEARING. By 8/8/2014, plaintiff shall submit a written settlement demand to defendant, which provides a comprehensive assessment of the facts and applicable legal principles. By 8/15/2014, defendant will respond in kind with its offer and a comprehensive assessment of the facts and the applicable law. The demand and offer must reflect a good-faith assessment of the merits of the case, the risk inherent in the litigation, and the expense and delay (including dispositive motions, expert discovery, pretrial preparation, trial, post-trial motions, and appeal) of pursuing the cause rather than resolving it. A SETTLEMENT DEMAND THAT IS EQUAL TO WHAT THE PLAINTIFF THINKS IS RECOVERABLE AT TRIAL IS NOT A GOOD FAITH SETTLEMENT DEMAND, AND A DEFENDANTS RESPONSE MUST CONTAIN A COUNTER OFFER, UNLESS OF COURSE, THE DEFENDANT DOES NOT INTEND TO PAY ANY AMOUNT, WHICH IS HIS/HER RIGHT. All parties are directed to refer to and must review my "Instructions and Procedures for Settlement Conferences," available at "www.ilnd.uscourts.gov" and to comply with its directives before appearing at the settlement conference. Parties with FULL AUTHORITY to settle must be personally present at the conference. FULL AUTHORITY DOES NOT MEAN PRESCRIBED AUTHORITY BEYOND WHICH THE PERSON ATTENDING THE CONFERENCE MAY NOT PROCEED WITHOUT FURTHER CONSULTATION. A member of either parties in-house legal department shall not qualify as a person with full authority. A member of either parties in-house legal department shall not qualify as a person with full authority. Participation by telephone will not be permitted. Plaintiff's counsel shall deliver copies of the required settlement letters to the courtroom deputy in Room 1010 from both plaintiff and defendant by 8/20/2014. All settlement documents must have protruding tabs separating exhibits or attachments, pursuant to Local Rule 5.2(e). Non-compliance with 8/20/2014 date document submission date makes it difficult and often impossible for the conference to proceed effectively. Failure to comply with the 8/20/2014 document submission date rule may necessitate cancellation of the conference. Parties cannot unilaterally agree to cancel a scheduled settlement conference. Permission not to proceed must be obtained from the court pursuant to written motion, and any party wishing to vary any of the procedures set forth in the standing order must make an appropriate request by written motion prior to the exchange of settlement letters described above. FAILURE OF THE PARTIES TO COMPLY WITH ANY OF THE REQUIREMENTS OF THIS ORDER, MAY NECESSITATE IN THE SETTLEMENT CONFERENCE BEING STRICKEN, AND THE PARTIES RESUBMITTING SETTLEMENT POSITION LETTERS. IT MAY ALSO RESULT IN A SUBSTANTIAL MONETARY SANCTION WITH THE NON-COMPLIANT PARTY BEING RESPONSIBLE FOR ANY FEES AND COSTS INCURRED BY THE COMPLIANT PARTY. In support of their settlement demands, each party must submit evidence of at least three settlements or verdicts in comparable cases. Status hearing date of 9/2/2014 is stricken.Mailed notice (jms, ) |
Filing 63 MINUTE entry before the Honorable Edmond E. Chang: Status hearing held. The parties informed the Court that they will be able to complete fact discovery by the 08/15/2014 deadline. Counsel for both parties agreed to a settlement conference with the magistrate judge. Defendant wanted to keep in place the summary-judgment briefing schedule. After further consideration, the Court will keep a summary-judgment schedule in place, but to alleviate the time pressure (and the devotion of resources) just a bit, the opening summary judgment motion and brief is due by 09/10/2014. Plaintiff's response is due by 10/14/2014; this guarantees that even if there is follow-up settlement negotiations after the 08/25/2014 settlement conference, Plaintiff need not start preparing the response until after that time. Defendant's reply brief is due by 10/29/2014. Status hearing set for 09/02/2014 at 8:30 a.m. Mailed notice (slb, ) |
Filing 62 MINUTE entry before the Honorable Edmond E. Chang: At the 07/29/2014 status hearing, if at all practicable, the parties shall report on whether they wish to have a settlement conference with the magistrate judge, in light of the decision on the dismissal motion and discovery so far. Also, in reviewing the docket entry concerning the potential defense summary-judgment motion, Mindtree should bear in mind that Judge Chang will not consider two rounds of summary judgment briefing. In other words, if Mindtree is permitted to move for summary judgment before expert discovery, and the motion is denied either on the merits or because Publications is correct that more discovery is needed per Rule 56(d), then there will not be a second summary-judgment round after expert discovery. Mailed notice (slb, ) |
Filing 61 MEMORANDUM Opinion and Order signed by the Honorable Edmond E. Chang. For the reasons stated in the Opinion, Mindtree's partial motion to dismiss #44 is granted. Status hearing of 07/29/2014 at 8:30 a.m. remains in place. Mailed notice(slb, ) |
Filing 60 MINUTE entry before the Honorable Jeffrey Cole:Motion hearing held. Plaintiff's motion for an extension of time to complete discovery #54 is granted, but only to 8/15/2014,rather than the 90 days requested in the motion. The depositions of Varadharajan K.V., Ranjith Kutty, Aravind Patil, and Suresh HP may be video conference and may be videotaped at plaintiff's expense. The depositions of those in India shall begin at 8:00 am Chicago time and shall go forward on 7/24/2014, 7/25/2014, 7/28/2014, and 7/31/2014 or such other dates as the parties select. Defendant's oral motion for leave to file its motion for summary judgment and supporting memoranda on 8/29/2014 is granted. Defendant's oral motion for leave to file a 20 page supporting brief is granted. Plaintiff is given 20 pages for his response brief. Reply is limited to 15 pages. Plaintiff reports that it will have expert testimony in support of its response to defendant's motion for summary judgment. In that event defendant may need to take discovery. See FRCP Rule 56(d)(2) and (3). But that will be a matter for Judge Chang to decide. Response is to be filed by 9/29/2014. Reply is to be filed by 10/14/2014. Status hearing is set for 9/2/2014 at 8:30 am. The parties are urged to call chambers at 312-435-5601 if any issues arise during the depositions.Mailed notice (jms, ) |
Filing 59 MINUTE entry before the Honorable Jeffrey Cole:Hearing on plaintiff's motion for extension of time to complete discovery #54 is set for 6/19/2014 at 08:30 AM. Plaintiff is directed to submit a copy of its motion to Room 1010 by 12:00 pm on 6/18/2014.Mailed notice (jms, ) |

Mailed notice (ao,) |

The parties reported on the status of discovery, which has been substantial, including 6 Rule 30(b)(6) depositions of Plaintiff's representatives, with one more scheduled for next week. But in light of the foreign-based witnesses and the volume of discovery, and for the reasons stated in open court, fact discovery is extended to 07/18/2014 at 9:30 a.m. Status hearing set for 05/20/2014 at 9:30 a.m. Mailed notice (slb, ) |

Filing 43 AMENDED complaint by Publications International Limited against Mindtree Limited (Weber, Dorothy) |
Filing 42 MINUTE entry before the Honorable Jeffrey Cole:Magistrate Judge Status hearing held. Parties report that they are not ready for a settlement conference and will not be ready until four months or more have passed. They have concluded, quite rightly it seems to me, that substantial discovery must proceed any informed judgment about the possibility of settlement. The parties have agreed that the most efficient course is to notify Judge Chang when they are ready for a settlement conference and to ask him to re-refer the case. All matters relating to the referral having been completed the case is returned to Judge Chang. Judge Honorable Jeffrey Cole no longer referred to the case.Mailed notice (jms, ) |
Filing 41 MINUTE entry before the Honorable Jeffrey Cole: On 12/2/13, the parties informed the court that they thought a settlement conference at that time was premature given the pendency of the defendant's motion to dismiss. #30 . On 1/13/14, Judge Chang granted, over objection, the plaintiff's motion for leave to file an amended complaint and set 1/27/14 as the date for the filing of the defendant's motion to dismiss. The plaintiff's response is due 2/17/14. The reply brief is due on 3/3/14. In light of these developments, it would appear that it would continue to be premature to set a settlement conference pursuant to Judge Chang's referral for a settlement conference. However, this should not be left to inference and the case is set for status on 1/17/14 at 8:30 a.m. All counsel must appear. There will be no continuances of this date.Mailed notice (jms, ) |

Defendant's motion to dismiss the amended complaint is due by 01/27/2014. The brief shall not exceed 20 pages. Plaintiff's response due 02/17/2014, and shall not exceed 20 pages. Defendant's reply due 03/03/2014. The fact discovery deadline of 04/15/2014 is extended to 05/14/2014. Hearing held on Defendant's motion for protective order seeking relief for obligation to pay significant non-party discovery expenses #33 . For the reasons stated in open court, Defendant's motion #33 is granted in part. From this point forward, including January 2014's costs, Plaintiff and Defendant will share equally the ongoing non-party costs of preserving the website. By 11/11/2013, plaintiff shall submit a written settlement demand to defendant, which provides a comprehensive assessment of the facts and applicable legal principles. By 11/18/2013, defendant will respond in kind with its offer and a comprehensive assessment of the facts and the applicable law. All parties are directed to refer to and must review my "Instructions and Procedures for Settlement Conferences," available at "www.ilnd.uscourts.gov" and to comply with its directives before appearing at the settlement conference. FAILURE OF THE PARTIES TO COMPLY WITH ANY OF THE REQUIREMENTS OF THIS ORDER, MAY NECESSITATE IN THE SETTLEMENT CONFERENCE BEING STRICKEN, AND THE PARTIES RESUBMITTING SETTLEMENT POSITION LETTERS.
