MEMORANDUM Opinion and Order The Court denies plaintiff's motion 34 for leave to file the proposed amended complaint. Instead, the Court grants plaintiff leave to file a second-amended complaint against original defendants Wells Fargo NA and Bank of America NA and grants plaintiff leave to include claims for promissory fraud (i.e., Counts I and IV of the proposed amended complaint) and for violations of the Illinois Consumer Fraud Act (i.e., Counts III and X of the original complaint , Counts II and IV of the proposed amended complaint). MEMORANDUM Opinion and Order: The Court grants in part and denies in part defendants motion to dismiss 18 . Counts XIV, XV, XVI and XVII are dismissed with prejudice. Counts I, II, IV, V, VI, VII, VIII, IX, XI, XII and XIII are dismissed without prejudice. Because many of the defects do not seem curable, plaintiff is not granted leave to amend. If plaintiff wishes to amend any of the claims which the Court dismissed without prejudice, he will need to file a motion for leave to amend, alon g with a proposed amended complaint and a memorandum of law that explains how the proposed amended complaint cures the defects outlined in this decision.
