The motion is granted as to Boyd's sta te-law claims for assault and battery arising from the events on November 14, 2011 (Counts VI, VII). These claims are dismissed with prejudice. The motion is also granted as to Boyd's "harassment" claim under Section 1983 (Count II I), which is dismissed without prejudice. The motion is denied as to the remaining counts. At the status hearing on 6/8/15, the parties shall be prepared to discuss a schedule for discovery and any Pavey hearing. [For further detail see attached order.] Notices mailed by Judicial Staff.
