The motion is granted as to the Count II excessive force claim against Kirk and Muniz, the Count III claims that Kirk , Muniz, and Fabiani (if Fabiani did not use excessive force) failed to intervene to prevent Copp and/or Fabiani from using excessive force against plaintiff, the Count V battery claims against Kirk and Muniz, and the conspiracy claims in Counts I, I I, IV, V, and VI.
