ORDER Defendant Oruta has renewed his motion for leave to appeal in forma pauperis. The new supporting affidavit fails to correct the deficiencies noted in the Court's order dated 6/6/2014 because it includes only zeros. In addition, the Court of Appeals would likely conclude that it lacks jurisdiction to hear his appeal of this Court's judgment because an order remanding a case to state court based on a lack of subject matter jurisdiction is not reviewable on appeal. See 28 U.S.C. section 1447(d); Rubel v. Pfizer, Inc., 361 F.3d 1016 (7th Cir. 2004). His appeal is therefore frivolous, and for these reasons the renewed motion for leave to appeal in forma pauperis [ECF No. #26 ] is denied. Signed by the Honorable Harry D.
