Filing 107 MEMORANDUM Order: Counsel for plaintiffs Fabian Basina and Mikhail Ruiz and for defendant Sushi Thai have jointly filed the "Parties Motion for Pre-Trial Conference Date" (the "Motion," Dkt. No. 106) seeking "an Order setti ng a Pretrial Conference Date." Because it is anticipated that this Court's calendar will be assigned to its colleagues by random computerized assignment on or about September 1, the Motion is denied at this time. It is expected that the assignee judge will enter an appropriate order setting such a pretrial conference date. Signed by the Honorable Milton I. Shadur on 8/1/2017:Mailed notice(clw, ) |
Filing 88 MEMORANDUM Opinion and Order: For reasons stated in the Court's 11/21/2016 memorandum opinion and order, plaintiffs' motion for partial summary judgment 66 is granted as to plaintiff Ruiz and denied as to plaintiff Basina. Status hearing set for 11/30/2016 at 09:15 AM. Signed by the Honorable Milton I. Shadur on 11/21/2016:Mailed notice(clw, ) |
Filing 46 MEMORANDUM Opinion and Order: Motion 39 was a corrected copy of Motion 32 , which should have been denied on the ground of mootness. To clear the record, Motion 32 is now ordered denied on that ground. Defendant's motion for leave to fi le an amended answer was also sought in Motion 39 and had been granted by this Court. Defendants motion for leave to file amended responses to requests to admit 39 is denied for the reasons stated in the Memorandum Opinion and Order. Signed by the Honorable Milton I. Shadur on 9/29/2015:Mailed notice(clw, ) |
Filing 43 MEMORANDUM Order: Defendant's Amended Answer is stricken. A Second Amended Answer is ordered to be filed on or before September 18, 2015. (For further details see Memorandum Order) Signed by the Honorable Milton I. Shadur on 9/2/2015:Mailed notice(clw, ) |
Filing 16 MEMORANDUM Order: This Court has just received a puzzling motion by plaintiffs' counsel in this action -- a filing labeled "Plaintiffs' Motion for Discovery" that counsel has scheduled for presentment on March 4. Apparently plain tiffs' counsel mistakenly believes that court permission is needed before a federal litigant may proceed with discovery. Not so -- nothing in Fed. R. Civ. P. ("Rule") 26 or in ensuing Rules 27 through 37, which collectively make up th e Rules' Title V captioned "Disclosures and Discovery," even hints at such a requirement. Accordingly the motion noticed up by plaintiffs' counsel (Dkt. 14) is denied as moot.Counsel is free to proceed with discovery, and the previously scheduled status hearing at 9 a.m. April 3, 2015 will remain in effect. Signed by the Honorable Milton I. Shadur on 2/25/2015:Mailed notice(clw, ) |
