For the reasons stated in the Opinion, Plaintiff's motion for summary judgment on liability 34 is granted in part (on the issue of whether individual liability applies) and denied in part (on the enterprise issue and on underpayment). As explained in the Opinion, Plaintiff may move for summary judgment again on the enterprise issue, but only after conferral with the defense by 12/14/2015.
