April 29, 2016 Opinion or Order Filing 59 MEMORANDUM Order regarding the prose document (Dkt. No. 58) that plaintiff filed. Signed by the Honorable Milton I. Shadur on 4/29/2016:Mailed notice(clw, )
March 24, 2016 Opinion or Order Filing 56 MEMORANDUM Order: Joseph Felton ("Felton") continues to bombard this District Court with a series of filings of a repetitive nature, some captioned with the name of the Court of Appeals for the Seventh Circuit and others bearing the name o f this District Court. Because those filings are hard to decipher and because this Court has no jurisdiction over Felton's case -- it is on appeal to the Court of Appeals under its Case No. 14-3211 -- this Court has had occasion to transfer an entire group of Felton's recent filings to the Court of Appeals for current action. Felton's most recent motion (Dkt. No. 55), just filed on March 21, 2016, bears only the name of this District Court and the now-superseded District Cour t case number. But because, as stated earlier, this Court is without jurisdiction while Felton's case is on appeal, the filing is improper and is accordingly stricken. To stop the constant flow of filings emanating from Felton, he is ordered to file nothing further in this District Court during the pendency of his current appeal. Signed by the Honorable Milton I. Shadur on 3/24/2016:Mailed notice(clw, )
October 16, 2015 Opinion or Order Filing 38 MEMORANDUM Order: Joseph Felton ("Felton") has just submitted a hand-printed request for documentation -- a "record of all docketing orders and statements by judges and courts" -- in this action. Because Felton's case is pend ing on appeal and the Court of Appeals has appointed Joon Oh of the Winston & Strawn firm to represent him, attorney Oh is best equipped to accommodate Felton's request after conferring with his client to determine precisely what Felton is seeki ng that he or his appointed counsel do not already have and the basis for the request. Accordingly a copy of this memorandum order is being transmitted to attorney Oh together with a photocopy of Felton's current submission (District Court Dkt. No. 37). Signed by the Honorable Milton I. Shadur on 10/16/2015:Mailed notice(clw, )
March 23, 2015 Opinion or Order Filing 29 MEMORANDUM Order. Signed by the Honorable Milton I. Shadur on 3/23/2015. Mailed notice. (jl, )
February 20, 2015 Opinion or Order Filing 25 MEMORANDUM Order: On October 7, 2014 plaintiff Joseph Felton ("Felton") filed a notice of appeal from the order entered in this District Court that had dismissed his Complaint and the civil case bearing the case number listed in the caption of this memorandum order. With the Court of Appeals having recently directed this Court to make the calculation under 28 U.S.C. § 1915 applicable to Felton's appeal, it has become necessary to obtain the printout reflecting transactions i n Felton's trust fund account at the Cook County Department of Corrections for the entire six-month period that ended on October 7 (the printout that accompanied Felton's In Forma Pauperis Application, which in turn accompanied his notice o f appeal, extended only to September 15, 2014). Because it would involve an extra (and needless) step to request Felton himself to obtain the missing information for the period from September 15 through October 7, 2014, this Court is transmitting a c opy of this memorandum order directly to the Cook County Department of Corrections with a request that a printout covering that gap period be transmitted directly to this District Court. For that purpose the fiscal officer at that institution is adv ised (1) that Felton's Resident Identification Number is 20140319001 and (2) that to facilitate proper handling the transmittal of the requested information should bear both case numbers listed in the caption of this memorandum order and should be addressed as follows: Office of the Clerk, United States District Court, 219 South Dearborn Street, Chicago IL 60604, Attention: Fiscal Department. Signed by the Honorable Milton I. Shadur on 2/20/2015:Mailed notice(clw, )
October 30, 2014 Opinion or Order Filing 20 MEMORANDUM Opinion and Order. Accordingly this Court denies Felton's in forma pauperis motion because the frivolousness of his underlying claim (and hence of his appeal) causes the appeal not to have been taken in good faith (see 28 U.S.C. 67;1915(a)(3)).1 As the Court of Appeals' October 28 order reflects, Fed. R. App. P. 24 calls for him to refile the motion before the Court of Appeals. Accordingly Felton is assessed that initial partialfiling fee of $24, and the Cook Co unty Jail trust fund officer is ordered to collect that amountfrom Felton's trust fund account there and to pay it directly to the Clerk of Court ("Clerk"): Office of the Clerk United States District Court 219 South Dearborn Street Chicago IL 60604 Attention: Fiscal Department Signed by the Honorable Milton I. Shadur on 10/30/2014:Mailed notice(tlp, )
September 8, 2014 Opinion or Order Filing 5 MEMORANDUM Opinion and Order. It is frankly an affront to the judicial system for Felton to attempt, like the alchemists of the Middle Ages, to transmute base metal into gold. Section 1915A(b)(1) amply justifies the dismissal of both Felton's Complaint and this action as frivolous, and this Court so orders. Motion for leave to proceed in forma pauperis 4 denied as moot. Civil case terminated. Signed by the Honorable Milton I. Shadur on 9/8/2014. Mailed notice(tlp, )
