Filing 80 MEMORANDUM Opinion and Order: As set forth below, Preferred Capital's motion for summary judgment 26 is granted in part and Chakwin's cross-motion for summary judgment 31 is granted in part. Status is set for November 4, 2015 at 9:30 a.m. in order to set a trial date on the issue of whether the violation of the Illinois Interest Act was intentional. The parties are directed to meet and confer regarding (1) the relief, if any, Chakwin is entitled to in the event of a finding tha t the violation was unintentional; and (2) the status of Preferred Capital's remaining claims of breach of the covenant of good faith and fair dealing and special damages. The parties shall then each file a statement no later than October 26, 2015 indicating their responses to these two issues.
