MEMORANDUM Opinion and Order:For the foregoing reasons, Defendants motion to dismiss, R. 28, is grantedwithout prejudice with respect to Plaintiffs alleged violation of § 1030(a)(5)(C) of Count II, and denied in all other respects. Plaintiff is granted 14 days to amend its complaint if there are facts which would support an allegation of damage in light of Jins representation that she destroyed the PPE-issued laptop.
