After reviewing the briefing on Defendant Timothy Evans' motion for summary judgment and Plaintiffs' motion for reconsideration, the Court agrees with Plaintiffs that Evans did not sufficiently support the entry of judgment on a disparate impact claim and that, arguably, Count IV of the amended complaint asserts such a claim. From a review of the amended complaint and the summary judgment record, however, the Court has considerable concerns as to the viability of Plaintiffs' disparate impact claim, which the parties likely could address in a summary judgment motion targeted to the elements required to prevail on such a claim. Because the parties have a settlement conference scheduled for 12/3/19, the Court defers setting a briefing schedule on the disparate impact claim. In the event that the parties do not successfully settle the case on 12/3/19, the Court sets a status hearing on 12/18/19 at 9:30 a.m. to set a briefing schedule for summary judgment on Plaintiffs' disparate impact claim.
