Filing 20 ORDER: In the instant action, Defendants filed a motion to dismiss asserting that Plaintiff has not alleged sufficient facts. Plaintiff has filed a response to the motion to dismiss, and has requested leave to file an amended complaint in order to plead additional facts. Once the period for amending a complaint as a matter of course expires, "a party may amend its pleading only with the opposing party's written consent or the court's leave," and "[t]he court should freely giveleave when justice so requires." Fed. R. Civ. P. 15(a)(2). The instant action is still at the pleadings stage and is a relatively new case. Defendants have not shown that any prejudice would result from the proposed amended complaint. This is Plaintiff's first request to amend the complaint and there is no indication that an amendment to the complaint would be futile. Therefore, Plaintiff's motion for leave to file an amended complaint is granted. Plaintiff is given until May 4, 2016, to file an amended complaint. Defendants are given until May 25, 2016 to answer or otherwise plead to the amended complaint. Defendants' motion to dismiss #12 is stricken as moot.
