But the Court flags the following: first, there will not be two rounds of summary judgment motions, so if the defense wants to file a summary judgment motion *before* a defense expert disclosure, then the defense is alerted that there will not be a second motion after the defense expert disclosure. Second, with regard to a Daubert / Rule 702 challenge, the Court would require the issue to be briefed in the summary judgment motion itself. Very often a stand-alone Rule 702 challenge is too abstract without a concrete setting of the issues, both factual and legal, presented by the summary judgment motion.
