MEMORANDUM OPINION AND ORDER signed by the Honorable Matthew F. Kennelly on 6/23/2016: For the reasons stated in the accompanying, the Court denies Smith & Nephew's motion for judgment on the pleadings [dkt. no. 21]. The ruling and status hear ing set for June 28, 2016 is vacated. Counsel are directed to confer and attempt to agree on a pretrial and discovery schedule.
