Filing 145 MEMORANDUM Opinion and Order: For the reasons stated in the Order, Defendants' motion to strike 135 is granted in part and denied in part. Defendants' request for attorneys' fees in connection with bringing the motion to strike is de nied. Defendants' motion for summary judgment as to Plaintiff Brownlee's claims 122 is granted in part and denied in part. Defendants' motion for summary judgment as to Plaintiff Fleming's claims 124 is granted in part and den ied in part. The parties are instructed to file a joint status report on or before 2/24/2021 stating (1) whether both sides would like a settlement conference with the Magistrate Judge and (2) whether both sides are agreeable to a bench trial, and if so, whether they are agreeable to a virtual bench trial. Additionally, it appears that Defendants' Amended Local Rule 56.1 Statement of Uncontested Facts in Support of Summary Judgment 121 was designated as a "motion" on the case docket in error.
