March 14, 2018 Opinion or Order Filing 84 MEMORANDUM OPINION AND ORDER signed by the Honorable Matthew F. Kennelly on 3/14/2018: For the reasons stated in the accompanying Memorandum Opinion and Order, the Court denies plaintiffs' motion for class certification without prejudice in par t (with respect to count 1) and grants it in part (with respect to counts 2 through 4) [dkt. no. 49]. The Court certifies, pursuant to Rule 23(b)(3), the two subclasses described in the Memorandum Opinion and Order. Plaintiffs Bhattacharya and Kooth apillai are appointed as class representatives, and their current counsel are appointed as class counsel. The Court defers ruling on the parties' pending cross-motions for summary judgment to allow time for class members to receive notice of the action and to avoid running afoul of the rule against one-way intervention. See Costello v. BeavEx, Inc., 810 F.3d 1045, 1057-58 (7th Cir. 2016). The case is set for an in-person status hearing on March 28, 2018 at 9:30 a.m. The Court expects the parties, before that date, to discuss and attempt to agree upon a proposed class notice or notices and to work on compiling a list of appropriate notice recipients. Kennelly on 12/4/2016: For the reasons stated in the accompanying order, the Court denies defendants' motion to dismiss but rules that plaintiffs are not entitled to statutory penalties on count 1 of their complaint in its current form. The case remains set for a status hearing on December 5, 2016 as previously ordered. (mk)
