Lee:The Court ordered Defendants to file a motion in limine regarding the issue of employer identity by 6/14/19, and Plaintiff to respond by 6/28/19. Defendant's motion is now before the Court. In the motion, Defendants seek to bar Plaintiff from introducing any evidence at trial that Defendant Gannett Co., Inc., was her employer. Specifically, Defendants seek to exclude the statements of four corporate employees--Theresa Allen, Michael Safran, Randy Kilgore, John Marquardt--about Defendant Gannett Satellite Information Network, LLC. Defendants also seek to bar Plaintiff from introducing any other previously undisclosed evidence that Gannett Co., Inc. was her employer. Defendant's motion #148 is granted. As an initial matter, Plaintiff did not respond to the motion by the Court's deadline. Additionally, the Court agrees with Defendants that Plaintiff has not established that any of the four witnesses have personal knowledge of the corporate structure of Gannett Co., Inc. and Gannett Satellite Information Network, LLC. Accordingly, none of these witnesses will be permitted to testify to that effect. Furthermore, evidence submitted by Defendants establishes that Gannett Satellite Information Network, LLC, was Plaintiff's employer. ORDER: The Court held a status hearing on April 3, 2019, wherein Plaintiff asked for this matter to be remanded to the Circuit Court of Cook County, Illinois, due to the entry of summary judgment as to all of her claims except one brought under state law. For the reasons provided herein, the Court concludes that it retains diversity jurisdiction over this action pursuant to 28 U.S.C. 1332. Accordingly, Plaintiffs oral motion to remand is denied. Briefly stated, the Court is concerned if it begins to award sanctions each time a party is successful on a discovery motion, then sanctions litigation will become an active appendage to this case and distract the parties from doing what they need to do complete discovery as expeditiously as possible. Therefore, there is good cause to deny both motions. Plaintiff's Motion for an Extension of Discovery Related to Delayed Production of Documents #49 is denied without prejudice because Defendants have agreed to allow Plaintiff to take a number of depositions of its former employees after the discovery close date. Specifically, Plaintiff is given leave to take the following depositions after the formal close of discovery on 10/20/17: Brent Rumfelt [scheduled for October 25 in Atlanta]; John Schram [Detroit]; Michael Safran [New York City]; Randy Kilgore [New York City]; and Sue Motiff [Virginia]; Fred Roth [Chicago]. Plaintiff shall use her best efforts to take these depositions by 11/20/17. There is no guarantee that Plaintiff will be allowed to take these depositions after that date. The parties are continuing to discuss Plaintiff's recently served request for production of documents and they will report on the status of those discussions at the next status hearing on 10/30/17.
