Filing 76 OPINION and ORDER: For the foregoing reasons, PIIC's motion to dismiss 56 is granted. The subject policy language is not ambiguous and necessitates a declaration that (a) either the 2010 Policies or the 2011 Policies (not both) apply to cover age for the Underlying Lawsuit; (b) the limits available under the relevant excess policy are $250,000 per abusive conduct and $500,000 in the aggregate; and (c) whether the 2010 Policies or 2011 Policies apply will depend on findings made in the Underlying Lawsuit and need not be decided by this courtthe issue is moot given that the relevant language in the 2010 Policies and 2011 Policies is identical.
