Filing 115 MEMORANDUM Opinion and Order; Therefore, the motion for summary judgment made by the Estate of Dr. Obaisi, Dr. Funk, and Wexford 103 is granted. Additionally, because the Court finds that Sorrentino has not produced evidence sufficient for a reaso nable jury to find that the delays in his treatment constituted deliberate indifference, the same must also be true for Sorrentino's claim against the Warden. For that reason, the Court grants summary judgment to the Warden, despite the Warden 039;s failure to file a motion. If Sorrentino objects to the grant of summary judgment in the Warden's favor (or any other aspect of this opinion and order), he should file a motion to reconsider within the 28 days provided by Federal Rule of Civil Procedure 59(e).
