Filing 554 Notice of Decision in LoanMe by CS Wang & Associate, Jay Schmidt Insurance Agency, Inc., Robert Meyer, Sat Narayan, Taysir Tayeh (Swetland, Benjamin) |
Filing 553 MINUTE entry before the Honorable Rebecca R. Pallmeyer: The court recognizes the potential that allowing new briefs will generate additional time-consuming effort for Plaintiffs' counsel. The court is also aware that a prompt ruling on class certification may promote settlement efforts. Briefing on the original class certification motion, filed almost two years ago, was lengthy and voluminous, however, and the court took Defendants at their word that the intention was to file documents that were "streamlined and focused." The court expects the parties' intended submissions will spare the court the effort of wading through briefs filed many months ago and expedite a ruling. The motion for reconsideration #552 is denied. Notice mailed by judge's staff (ntf, ) |

Filing 538 MINUTE entry before the Honorable Rebecca R. Pallmeyer: The court acknowledges receipt of the parties' status report #534 and will rule on the renewed motions in due course. Defendants have asked that the court reserve ruling for 35 days #535 , pending the California Supreme Court's expected ruling on an issue that may be relevant to the proposed class definition. Plaintiffs object to any such delay. The court need not weigh in on the propriety of a stay in this case because it is unable to issue ruling within the next 35 days. The parties are invited to notify the court promptly when that ruling is made. Defendant First Data Merchant Services, LLC.'s motion for leave to file additional appearances #536 is granted. Filing 528 MOTION by Attorney George J. Tzanetopoulos to withdraw as attorney for Fifth Third Bank, National Processing Company, Vantiv, Inc.. No party information provided (Tzanetopoulos, George) |
Filing 527 MINUTE entry before the Honorable Rebecca R. Pallmeyer: Plaintiffs, five small California businesses, seek certification of a class of businesses which received telemarketing calls that were recorded without their consent, in violation of California law. Plaintiffs have proffered the opinions of three experts in support of class certification: Christina Peters-Stasiewicz, Randall A. Snyder, and Andrew S. Fletcher. The only opinion unique to Mr. Snyder is a proposed method for identifying whether calls were received in California. If the court concludes that class certification is appropriate, the use of claim forms or affidavits to determine whether calls were received in California, and the types of phones on which calls were received, would be relatively easy and manageable. The court therefore terminates the motions to strike Mr. Snyder's expert testimony #397 and #412 as moot. Since tendering Ms. Peters-Stasiewicz's opinion, Plaintiffs have obtained certain call recording records and lead lists; they assert it will no longer be necessary to rely on the process Ms. Peters-Stasiewicz proposed to determine the identity of entities who received the challenged calls. The court therefore terminates motions to strike her testimony, as well #394 and #409 , without prejudice to renewal should Plaintiff later conclude that process is indeed necessary. The Ironwood Defendants' motion to exclude expert opinions is unsupported by a memorandum, and merely adopts motions filed by other Defendants. That motion #425 is terminated. Any ruling disqualifying an expert will be applicable to all Defendants. Notice mailed by judge's staff (ntf, ) |
Filing 526 ATTORNEY Appearance for Defendants Fifth Third Bank, National Processing Company, Vantiv, Inc. by John Michael Touhy (Touhy, John) |
Filing 525 MINUTE entry before the Honorable Rebecca R. Pallmeyer: In their Second Motion for Spoliation Discovery [497, 499], Plaintiffs sought "a forensic inspection of Ms. [Darcy] Klaus's computer(s), phone(s), and files at Vantiv's expense in order to identify how Ms. Klaus's data was destroyed and, if possible, recover it. Plaintiffs further seek the identity of the Vantiv employees who implemented Vantiv's apparently ineffective litigation hold process, so they can be questioned." The court has not granted this motion. Consistent with its obligation to monitor the proportionality of discovery and its cost (already extraordinary in this case), and concern for attorney-client privilege, the court has not authorized the broad inquiry that Plaintiffs are seeking. Instead, following a telephone hearing, the court ordered, in relevant part, that Vantiv "produce a witness for a brief deposition on document preservation, destruction, etc." Defendant Vantiv has moved to clarify that order. Vantiv reports that Plaintiffs have asserted that Plaintiffs believe they are entitled to question Vantiv attorneys and staff who implemented Vantiv's litigation hold process and that Vantif must identify all persons who implemented that process. Vantiv's motion #523 is granted. Plaintiffs are correct that neither counsel nor the court referred to the contemplated deposition as a Rule 30(b)(6) deposition, but what the court intended is akin to such a procedure. The court expects Vantiv promptly to identify an individual who can testify knowledgeably about its process for document preservation. The court expects the deposition of this witness may well alleviate concerns about spoliation. If it does not, Plaintiffs will be free to seek further relief. Notice mailed by judge's staff (ntf, ) |

As explained in that conference, Plaintiffs have leave to file their reply in support of the earlier motion for class certification, on or before 9/29/2020. Filing 487 MOTION by Plaintiffs CS Wang & Associate, Jay Schmidt Insurance Agency, Inc., Robert Meyer, Sat Narayan, Taysir Tayeh to certify class Motion to Certify the s. 632 Classes (Swetland, Benjamin) |
Filing 486 MEMORANDUM Opinion and Order. The court denies in part and strikes without prejudice in part the Wells Fargo Defendants' amended motion for judgment on the pleadings #439 . The court likewise strikes without prejudice the Fifth Third Defendants and Ironwood Defendants motions for judgment on the pleadings #433 , #441 . Proceedings related to Plaintiffs' claims under CAL. PENAL CODE 632.7 are stayed pending the California Supreme Court's decision in Smith v. LoanMe, 460 P.3d 757 (Cal. 2020). The Wells Fargo Defendants' initial motion for judgment on the pleadings #391 is superseded by their amended motion and the court therefore strikes it as moot. Plaintiffs' motion for discovery #467 in connection with the Wells Fargo Defendants' motion for judgment on the pleadings is denied as moot. The Wells Fargo Defendants' motion to strike #470 Plaintiffs' response to the brief of the State of California as Amicus Curiae is likewise denied as moot. Plaintiffs' motion for class certification #444 is stricken without prejudice to renewal as explained above. The parties' agreed motion for an amended protective order filed by the Wells Fargo Defendants #405 is granted. Finally, because Defendants did not file objections to Plaintiffs' motion for an extension of time to complete discovery within five days of this court's order of July 15, 2020 #485 , Plaintiffs' motion #484 is granted. Within 14 days, the parties are directed to advise the court of what additional discovery, if any, is necessary. Also within 14 days, the parties are directed to submit a proposed briefing schedule for Defendants' motions to exclude expert opinions, and for Plaintiffs' renewed motion to certify the 632 classes, if any. Telephone status conference is set for September 22, 2020 at 10:00 a.m. Members of the public and media will be able to call in to listen to this hearing. The call-in number is 877-336-1839 and the access code is 6708061. Counsel of record will receive an email 10 minutes prior to the start of the telephonic hearing with instructions to join the call. Persons granted remote access to proceedings are reminded of the general prohibition against photographing, recording, and rebroadcasting of court proceedings. The court directs that written objections to the request be filed within five days. Absent such objections, the court will grant the motion and set a telephone status conference for early September.
