MEMORANDUM OPINION AND ORDER Signed by the Honorable Robert M. Dow, Jr on March 23, 2020. For the reasons stated below, Arrow's motion to dismiss the amended complaint 88 is granted in part and denied in part. NewSpin's claims for unjust enrichment are dismissed. NewSpin's claim for fraud is also dismissed, but NewSpin is granted leave to amend that claim by May 7, 2020. Arrow's motion to dismiss is denied as to the three contract-based claims. Arrow's motion to dismiss as NewSpin's negligent misrepresentation claims is denied without prejudice and subject to renewal based on the supplemental briefing ordered above.
