OPINION and Order: For the reasons stated in the accompanying Opinion and Order, the Court grants in part and denies in part MJN's motion to dismiss 16 . The Court dismisses O'Risky's common law retaliatory discharge claim (Count 4) with prejudice. The Court denies MJN's motion to dismiss O'Risky's DFA retaliation claim (Count 3) without prejudice to refiling after the Supreme Court issues its decision in the Digital Realty Trust, Inc. v.
