Filing 109 MEMORANDUM Opinion and Order Signed by the Honorable John J. Tharp, Jr on 4/25/2018: For the reasons stated in the Memorandum Opinion and Order, the Court grants the defendant Board of Education's motion to dismiss 30 . The plaintiff's Sec tion 1983 claim against the Board (Count I) is dismissed with prejudice. Because the remaining claims against all individual defendants have also been dismissed, the indemnification claim against the Board (Count V), which is dependent upon a finding of liability against the individual defendants, is also dismissed. Judgment will be entered in favor of defendant Board of Education. The plaintiff's motion to file a third amended complaint 105 is denied; no hearing on the motion will be con ducted on 4/26/18 as noticed. To the extent that plaintiff seeks to file new claims, or to reassert claims that have been dismissed without prejudice, she must do so in a new case.
