Chang: In response to an inquiry about the stipulated dismissal, R. 23, the attorneys called the courtroom deputy on a conference call to report that they would like another three weeks. To avoid unnecessary status hearings and to provide time to file the stipulated dismissal with prejudice, the case is dismissed without prejudice and with full leave to reinstate via motion filed by 03/05/2018. If no motion to reinstate is filed by that date, then the dismissal will automatically convert to a dismissal with prejudice, without further action by the Court. | Filing 16 MINUTE entry before the Honorable Edmond E. Chang: Status hearing held. Rule 26(a)(1) disclosures due 06/23/2017. The first-round of written discovery requests must be issued no later than 07/17/2017. Responses to the first-round of written discovery due by 08/17/2017, as a Court-set deadline that is not extendable absent a motion and good cause. Fact discovery, including treating physicians (Rule 26(a)(2)(C) disclosures for any treaters are due no later than 60 days before the close of fact discovery), shall close by 12/15/2017. Plaintiff anticipates only garden variety emotional distress damages and does not anticipate disclosing a mental-health treater. Any other Rule 26(a)(2) expert disclosures (whether retained or not) are due 30 days after the close of fact discovery, and the 30-day deadline is adjusted automatically if the close of fact discovery is adjusted. No summary judgment motions may be filed before the close of discovery without leave of Court. Status hearing set for 08/21/2017 at 9:30 a.m. Plaintiff shall make a formal settlement demand by 06/23/2017 on Defendant, explaining in detail the basis for liability, itemizing damages, and making a good-faith demand that takes into account the risks of litigation, the time and expense of litigation. Defendant shall respond by 07/14/2017 to Plaintiff's demand, explaining in detail the basis for Defendant's offer and taking into account the same risks and costs of litigation. Defendants shall submit a copy of the demand and the offers to chambers through the Proposed Order e-mail account. The parties may jointly call the courtroom deputy for a settlement referral before the next status hearing. If the case is referred for a settlement conference, then the time that is then-remaining on the discovery deadline will be added onto the back-end of the current discovery deadline.
