Filing 39 MEMORANDUM Opinion and Order: Defendants' motion to dismiss, ECF No. 30 , is granted in part and denied in part. The complaint's § 1983 claims (Counts I, II, and III) against the Board and KIPP are dismissed, and the § 1983 clai ms are dismissed against all defendants except insofar as plaintiff asserts a state-created danger claim, as more fully discussed in this opinion, based on defendants' placing T.G. in the hallway. Defendants may move for dismissal on qual ified immunity grounds. If they choose to do so, the motion will be briefed as follows: the motion must be filed by and including 01/23/18; plaintiff's response is due by and including 02/06/18; and defendants' reply is due by and including 02/13/18.
